Distance Sales Agreement

BUYER

The individual whose name, surname, and address information are provided during the order process.

By accepting this Agreement, the BUYER acknowledges and agrees that they are obligated to pay the purchase price of the ordered products, any applicable shipping charges, and any additional fees associated with the order.

2. DEFINITIONS

LAW: Turkish Consumer Protection Law No. 6502.

REGULATION: Regulation on Distance Contracts (Official Gazette No. 29188, dated 27 November 2014).

SELLER: CUCIX YAZILIM TEKSTİL ORGANİZASYON DIŞ TİCARET LİMİTED ŞİRKETİ ("CUCIX")

BUYER: A natural or legal person acquiring goods or services for purposes other than commercial or professional activities.

WEBSITE: cuciwear.com.

GOODS: Textile products and accessories offered for sale through the Website.

3. SUBJECT OF THE AGREEMENT

This Distance Sales Agreement governs the rights and obligations of the parties regarding the sale and delivery of products ordered electronically by the BUYER through the SELLER's Website, in accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

The prices displayed on the Website are the current sales prices and remain valid until updated.

5. BUYER INFORMATION

The name, surname, delivery address, telephone number, and email address entered by the BUYER in the order form shall be deemed valid.

6. PRODUCT INFORMATION

6.1. The essential characteristics of the products (including type, color, size, and quantity) are displayed on the Website.

6.2. All prices displayed on the Website include applicable VAT and remain valid until updated.

6.3. The total purchase price, shipping costs, and payment details are presented on the order confirmation page.

6.4. Shipping costs are borne by the BUYER unless otherwise stated. Any free shipping promotions will be announced separately on the Website.

7. INVOICING

An invoice will be delivered together with the products or sent electronically. Requests for corporate invoices must be specified during the ordering process.

8. PRIVACY, PERSONAL DATA AND SECURITY

8.1. Appropriate technical and administrative measures have been implemented to ensure the security of the information entered by the BUYER on the Website.

8.2. Personal data provided by the BUYER is processed solely for order processing, delivery, customer support, and compliance with legal obligations.

8.3. The BUYER has the right to object to the processing of personal data. Requests may be submitted to info@cuciwear.co, and will be handled within the legally prescribed time limits.

9. GENERAL PROVISIONS

9.1. Before placing an order, the BUYER confirms that they have reviewed and understood the essential characteristics of the products, pricing, payment methods, and delivery conditions.

9.2. The ordered products shall be delivered within the period specified on the Website, provided that the legal maximum delivery period of 30 days is not exceeded.

9.3. The SELLER undertakes to deliver the products completely, free from defects, and in accordance with the specifications of the order.

9.4. If the ordered product cannot be supplied, the SELLER shall notify the BUYER in writing within 3 days of becoming aware of the situation and refund all payments within 14 days.

9.5. In cases of force majeure preventing delivery, the SELLER shall promptly notify the BUYER. If the order is cancelled for this reason, all payments shall be refunded within 14 days.

10. RIGHT OF WITHDRAWAL

10.1. The BUYER has the right to withdraw from this Agreement within 14 (fourteen) days following delivery of the products without providing any reason.

10.2. Notice of withdrawal must be submitted in writing to info@cuciwear.co.

10.3. Returned products must be unused and returned complete with their original packaging, labels, and accessories.

10.4. The SELLER shall refund all payments received within 14 days after receiving the withdrawal notice.

10.5. Unless otherwise required by applicable law, the cost of return shipping shall be borne by the BUYER.

11. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

  • Products that have been used, washed, or whose labels have been removed.

  • Underwear and intimate apparel that are unsuitable for return for hygiene reasons once their sealed packaging has been opened.

  • Customized or personalized products.

12. DEFAULT

If the BUYER defaults on payments made by credit card, the BUYER acknowledges that they shall be responsible to the issuing bank in accordance with the applicable credit card agreement. The SELLER shall not be liable for any disputes arising between the BUYER and the issuing bank.

13. COMPETENT AUTHORITY

Any disputes arising from this Agreement shall be subject to the jurisdiction of the Consumer Arbitration Committee or Consumer Court located in the BUYER's place of residence, in accordance with Turkish law.

The monetary jurisdiction limits announced annually by the Ministry of Trade of the Republic of Türkiye shall apply.

14. EFFECTIVE DATE

By completing the order form and confirming payment electronically, the BUYER declares that they have read, understood, and accepted all terms and conditions of this Agreement.

This Agreement becomes effective on the date it is electronically approved by the BUYER.
